Contest Your Partial Blame in an Automobile Accident

It’s common in vehicle accidents for the victim and the other motorist to share responsibility for the collision. For example, if one driver was speeding and the other was distracted, the result may have been a collision that resulted in significant injuries for the driver who was speeding. If you’ve been hurt in a car accident that you’re partly to blame for, you may want to get compensated for the same. The real question is: how can you argue your percentage of fault?

Starting with the basic- Traffic Ticket

A police officer may rush to the scene of the accident to ascertain who was at fault. They will issue a citation if they believe you or the other driver violated the traffic laws. A contested ticket must be pursued if you are issued one. When you try to settle a claim with your insurance company and accept guilt for a ticket, they will use that against you. If you choose not to plead guilty, the state will have the burden of proving the charges against you in court. In either case, legal counsel is available to you.

Keeping a Journal of Your Disagreement with Someone

Fighting the insurance company’s assertions about you is another way of attempting to prove the other motorist was at fault. If the insurance company claims you’re at fault, you should dispute this right away. In addition, you should send a note informing the recipient of your request. The following information should be included in your disagreement letter:

  • You’re arguing information.
  • Your rationale for believing that the insurance provider is at fault
  • A single piece of evidence that supports your account of what happened
  • Always have a copy of any correspondence between you and the insurance provider on hand.

Being Prompt in Your Response Following a Crash

Some of your activities at the site of the collision can help or damage your ability to prove that the other driver was at fault. Take the steps listed below, if you can. Please ask a passenger in your vehicle to accomplish the following if you aren’t physically capable of doing it yourself.

Request the names and contact information of anybody who may have eye-witnessed the accident. Take pictures of the locations of the vehicles, damage to them, other property damage, debris on the road, skid marks, and other pertinent components of the scene. Take images from all angles, and be sure to capture any road signs that have to be complied with at the moment of the collision. Contact the authorities and let them know about the crash. If you are hurt, call 911 or your local emergency number. Notify the negligent party’s insurance provider of the accident. If you need further assistance with that, we would recommend you talking with Jurewitz’s best lawyers here.
